1. Basic definitions

• Competitions: before registering for a specific one, you should read the specific rules that apply to each competition.

• Campaigns: Set of competitions.

• Competitors: the participants involved in the Competition.

• Competition Statistics: the statistics that each competitor has obtained for use in the Competition. These Statistics will be obtained from the pertinent sources established at any time by Be Number One Sport, the same sources being applicable to all participants in the Competition.

• Users: the users of the Platform.

• Wallet: that section of your profile in which you must have the amounts corresponding to the registrations of the Competitions in which you want to participate and in which the monetary prizes you win are managed.

• Norms: These are the General Norms of each Competition and the possible indications in question.

• Platform: Be Number One Sport, all content at https://benumberonesport.com and our Apps.

• Sports application accounts (third parties): those applications in which the User registers and stores his sports statistics activity.

• Organizer: Company, group, User, who creates or asks us to create campaigns and / or competitions.

2. What is Be Number One Sport?

Be Number One Sport is owned by Be Number One Sport, SL, an entity with address at Calle Camino Alto de Hortaleza 28, 28055, Madrid, registered in the Madrid Mercantile Registry (Volume 41174, Sheet M-730013, Folio 182, Registration 1), NIF B42988725 and contact email info@bnosport.com.

Specifically, it is a platform that organizes online sports competitions.

You must be clear about these characteristics of the Platform and the Competitions that take place on it:

• No element of chance is included to determine the result.
• Competitions include a minimum of two or three participants.
• Competitors are subject to the same conditions.
• For the Competition to be valid, there must always be the victory of one or more Competitors over the rest.
• The element of chance may only intervene in a residual way in certain characteristics of the competition, in no case is it Be Number One Sport who configures or determines it.

There may be changes regarding what type of Competitions are held, as well as the sports included in the Platform.

Keep in mind that the Rules may change over time so we recommend that before signing up for a Competition you read them again so that there are no surprises.

When we change the Rules, those changes will never apply to Competitions with participation already open.

3. My first steps in Be Number One Sport

The first thing you need to be part of Be Number One Sport is to register on our Platform. To do this, you must follow these steps:

• Guarantee that you are at least 14 years old.
• A valid email address.
• Name and surname.
• username. Valid
• Country.
• Birthday date.
• Password.
• Idiom.

Access to the Platform is prohibited to anyone under 14 years of age. Therefore, by accepting these Terms and Conditions, the User declares and acknowledges that they are over 14 years of age and that, in the event that the User is between 14 and 18 years of age, the Users legal guardian has reviewed these Terms and Conditions, and has agreed to them and to the use of the Platform by the User.

Remember that you will not be able to use abusive or inappropriate terms in your Username or commercial terms.

Optionally, you can also fill in the following fields on your profile:

• A profile image.
• The Url (s), ID (s) or unique identifier (s) provided by each Sports Application Account for each user. Remember that the ID must be yours and in no case will you be able to use someone elses ID.
• The data related to the award ceremony when we request them.

In order to participate in any of the Competitions, you must register for each of them accepting the general and specific rules applicable to each Competition. Keep in mind that we may need you to provide us with additional information to carry out the payment of the prizes in case of obtaining any.

Once you have registered on the Platform, we will send you a verification email to the email you have provided so that you can activate your account.

Remember that if you do not activate the account you will not be able to enter the Platform. We remind you that the data you provide must be yours and real, so we reserve the possibility of asking you at any time to prove the veracity of the data provided.

We want to make an impact on the importance of you providing us with a copy of your official identity document (DNI or other) if you want to make a balance withdrawal. If you are a minor (14-17 years old), in addition to your identification, we will need that of your legal guardian.

In the event that we ask you for a copy of it and you do not provide it to us within 1 month after we have asked for it, we can block the amount of the wallet and settle the account.

Once your account is activated, you will be able to interact on the Platform.

4. How does Be Number One Sport work?

Before explaining how Be Number One Sport works, the essential thing is:

• Be registered on the Platform.
• Have at least oneconfigured sports application account and validated.
• Have a smart watch, phone with gps app, GPS, smart trainer ... to be able to record the activity according to the conditions and details of the competition.
• Be registered in the Competition in question.
• Comply with these Conditions of Membership of the Platform that are included in this document and with the Rules and conditions of the Competitions.

Now, we are going to explain how Be Number One Sport works.

Competitors must carry out the activity according to the description and rules of the competition between the start date and the end date.

The activity will be recorded using the device chosen by the user (gps, smartphone, smartwatch ...). Each competitor may have time to carry out the activity one or more times according to the description of the competition, of which, they must provide the activity file of the best attempt made within the competition section in Be Number One Sport.

The results of the Competitions are obtained from the Sources that the competitors provide in the competition section previously registered in the sports application account selected in the competition registry and not from the interaction carried out by the participant on the Platform.

The activity file provided by the competitor must be published in the sports application account selected when registering for the competition. In the event that the activity provided by the competitor is not found in theaccount sports application selected, it will be a reason for disqualification and withdrawal of the award in case it was obtained. The activity can be carried out with a different account than the one registered, but at the end of the activity, it must be in the sports application account so that the other participants can see the original activity and verify that the information of their rival is true , or otherwise, report the statistics.

That is, Be Number One Sport establishes the Competition results objectively based on the Data from the Sources provided by the competitors.

In order to register for the different Competitions, you will have to pay the corresponding registration fee.

To make registration management as simple as possible, we have made available a wallet associated with your profile on the Platform.

The file of the activity carried out, depending on the sports application account selected in the competition registration, can be downloaded from the website of that account or from its app or from third-party apps in which the activity has been shared or synchronized .

In Be Number OneSport,files are acceptedextension, .fit .tcx and .gpx depending of the competition, you can use a file type and / or more.

5. Who can create or organize competitions ?:

All Users registered on the Platform can create competitions, the competitors being responsible for their acts and / or damages that they may generate both to third parties and to themselves.

They can also be organizers, groups, collectives, companies and / or organizations that get in touch with Be Number One Sport to create campaigns and competitions.

It should be noted that these groups, collectives, companies and / or organizations, if they organize one or several competitions in which public aid is necessary because these competitions take place in urban areas, these groups, groups, companies and / or organizations would be the responsible for any incident, damage that could arise in person by one or more competitors, leaving Be Number One Sport in any case undamaged against any claim. 6. Virtual Wallet

The wallet is a necessary element of our Platform to be able to manage your registrations in the Competitions, as well as the payment of the monetary prizes that you obtain.

Information to be known:

• Purpose of the purse: Its purpose will only be the payment of your registrations and the collection of the monetary prizes of the Competitions in which you have obtained a prize. You can also get promotions in it.

• Your wallet registrations: When you register for a Competition, the amount corresponding to the registration fee will be withdrawn from your wallet. You will know in advance the amount of that fee before registering. Keep in mind that if your wallet does not have the necessary amount to satisfy the registration fee, you will not be registered in the Competition and once you are registered it will no longer be possible to cancel your participation.

• How the prizes work: If you have been the winner of a monetary prize, the corresponding amount will be credited to your wallet as soon as possible after the results have been published on the Platform.

Be Number One Sport will apply the withholding that corresponds to the amount of the prize and we inform you that it may be necessary for you to carry out tax procedures in relation to the prizes you win through the Platform. We recommend that you inform yourself about this aspect.

• Other aspects of your wallet: You should know that all virtual balance in

Be Number One Sport must be worn at least once in successfully completed competitions. Once you have played and obtained a place with a prize, that amount of prize will be deposited in the virtual wallet and you will be able to request the withdrawal. Otherwise, the balance withdrawal to the Payment provider will be denied. In case of verifying the use of multiple accounts of the same user and/or activities for the attempt to withdraw the promotional amount, you will be immediately expelled from the platform.

• Balance: Balance deposits carry an amount of taxes which Be Number One Sport takes care of them, offering the amount chosen by the User without any type of decrease. There may be situations with our payment provider Paypal, in which the requested amount is pending acceptance, in which case the user must go to their Paypal account, select the payment made, and press Confirm Reception, to be deposited the amount in your virtual wallet. By not performing this action, the amount may take up to 21 days to be deposited in the users virtual wallet.

• Withdrawals of balance: Withdrawals of balance carry a certain amount of taxes depending on the amount to be withdrawn and the payment provider of the platform. These taxes will be announced to all Users of the platform within the virtual wallet. These taxes can be modified without any kind of notice over time. If you have more than € 300 in the virtual wallet and you make a withdrawal, a 19% withholding will be applied to the total balance of the wallet.

Important: If a balance deposit is made, any previously played balance or prizes will be blocked until the last deposit amount is used.

Deposits used in competition registrations which have been canceled due to not reaching the minimum number of players are not considered valid use of deposit.

7. Prizes

The User can see the information regarding the prizes in the competition section.

Once the official results of each Competition are published, whether you have been the winner of any of the prizes, or if you have not obtained a prize, we will contact you to indicate all the details.

If the User has obtained a monetary prize, it will be automatically entered into their wallet, in case it is a non-monetary prize, we will contact you by email.

In the event of obtaining a cash prize of more than € 300, a withholding of 19% will be applied to said amount.

8. Unsubscribe from the Platform By

sending an email to info@bnosport.com you can unsubscribe. We willprocess the request as soon as possible. When you unsubscribe, your data is deleted from our databases so if you want to register again in the future, you will start from scratch.

Possibly, the data will be registered in our database for a minimum of one year in case the Laws of Public Institutions require us to do so.

9. Conditions to be followed by every user of the Platform

In our Platform there is no room for malpractices and deception.

We detail those behaviors that will not be admitted in our Platform and that therefore may lead not only to disqualification from Competitions but also to expulsion from the Platform:

• The first of them is not to respect the Conditions of Membership that guarantee that we can all carry out our competitions correctly and enjoy them.

Any violation of these conditions, General Rules, by type or specific of Competition, may be sanctioned with the impossibility for the offender to participate in Competitions for a certain period, or even with expulsion from the Platform. Consequently, if the balances of the Users virtual wallet were greater than the amounts deposited, Be Number One Sport will proceed to reimburse only the latter, discounting the amount of balance withdrawal fees from our payment providers; In the event that the Users virtual wallet balance is less than the amounts deposited, Be Number One Sport will proceed to refund the amount of the balance that was credited in the Users virtual wallet, discounting the amount of balance withdrawal fees from our payment providers.

• In addition to these Conditions of membership, it is necessary that all Users respect the Rules. The User who does not respect the Rules may be disqualified from the Competition in which he has committed the infraction or deception, but may also be disqualified from all the Competitions in which he is registered.

You may also be expelled from the Platform if Be Number One Sport deems it necessary based on the offense committed.

• One of the most serious infractions linked to non-respect of the Rules is the manipulation of the Statistics or Competition Data. Manipulating and falsifying them is breaking the essence of Be Number One Sport, which is to establish fair prizes based on the Activity Data provided by the competitors. Any type of manipulation may be sanctioned with the expulsion of the Platform and that manipulation carried out by bots, scripting, not performing the competition in question correctly, using prohibited tools, using prohibited elements, carrying out the activity by someone other than the participant.

• Fraudulently obtained prizes: in the event that it is detected that a prize has been fraudulently won once it has already been paid, the immediately expelled User will be from the Platform and all the balance found in your purse. We understand by fraudulent activity any action or omission contrary to the rules described here and / or of each of the competitions organized by Be Number One Sport, to conduct in which deception is used in any way to obtain a reward or advantage of any type, and, in general, any behavior other than the fair and legal expected of the competitor. For example and among others, we consider fraudulent behavior the registration in competitions with aaccount sports application that does not represent the competitor, modifying the data related to the activities of theaccount sports application on purpose to deceive other competitors to understand that they do not has a corresponding level in that sport, manipulate characteristics of the competition to achieve a higher result that implies better statistics and / or access to prizes more easily, or impersonate the identity of another person.

• Impersonate the identity of another User, competitor or another person outside of Be Number One Sport: if it is carried out, it will be punished with the expulsion of the User offending from the Competitions in which he was participating in addition to not allowing him to participate in Competition the period of time that the Platform deems appropriate. If you detect that a User has impersonated your identity or that of another person on the Platform or outside of it, do not hesitate to contact us through the email info@bnosport.com. In the event that this behavior is repeated, the expulsion of thatfrom the Platform may be decided User.

• Not providing the information that proves your identity in case we ask for it, especially to be able to carry out the settlement of those prizes you have obtained.

• The realization of any type of betsis expressly prohibited in the Competitions organized on the platform.

• Competitions that must be held outdoorsmust be held without violating any traffic laws and without causing damages to third parties. The competitor is responsible for himself and for the correct performance of his activity without causing any damage. In case of damages or accidents caused by the competitor, he is fully responsible for his actions, leaving Be Number One Sport in any case undamaged against any claim.

• All participants must know their limits so as not to endanger their physical integrity or health.

Any disqualification implies not having access to the prizes of all the Competitions in which the participant is registered once the infringement is detected and whatever the reason for the disqualification and the loss of access to their wallet.

Regardless of the measures we take regarding your future interaction on the Platform, you must bear in mind that in the event that you totally or partially breach these Conditions of Membership, we reserve the right to legally demand any damages that may have been caused as a result of your breach.

10. Possible Incidents

We work so that the Platform works without problems, but even so, there may be some type of incident beyond our control.

If there is a failure in the technical capacity of Be Number One Sport, the treatment is different depending on the situation.

If a technical failure has occurred in a competition that has started, it will be canceled and the fee will be returned to each competitor in most cases.

There may be connection failures of the Users due to circumstances beyond the control of Be Number One Sport (errors of your internet connection, failures of the devices through which you are interacting on the Platform, activity files not readable by the platform for any technical aspect, fraudulent modification, corrupt ...).

We cannot be held responsible for these failures and you must bear in mind that any incident derived from them regarding the Competitions may imply, for example, that the activity is not registered or is not processed or is not validated correctly.

If any circumstance of this type occurs, you will be disqualified from that Competition (without any other consequence) to prevent your incident from affecting the rest of the participants in the Competition.

If you are participating in a competition, when uploading your activity, it is corrupted for any reason other than Be Number One Sport, we will try to process the file a maximum of 10 times. After those 10 times, if by eliminating your place, the competition continues to have the same or more players than the minimum number of players, we will refund the cost of registration. Otherwise, we will not be able to reimburse you for the registration fee for that competition.

The Platform is a space in which the different Users of the Platform can interact freely within the respect of these Conditions of Membership, therefore we cannot be held responsible for the breach of the law, morals and good customs of the different Users of the Platform, including for the infringement of intellectual property rights, rights to honor, personal and family privacy and the image of persons, property rights or of any other nature, belonging to a third party. Whenever we detect an infringement, we will apply the appropriate measures.

• Nor can we be held responsible for the illegitimate uses that Users may make of trademarks, product or service names, or in general, of any industrial property rights of a third party.

• Finally, you must bear in mind that the links and hypertexts that are made possible, through the Platform, such as accessing features or services offered by third parties, which do not belong to or are under the control of Be Number One Sport, we will not be responsible neither for the information contained therein nor for any effects that may arise from said information.

11. How does Be Number One Sport take care of my data?

The data that you provide us when you register on the Platform will be included in a personal data file called "Users" owned by Be Number One Sport, SL, domiciled in Madrid (CP: 28055), at Calle Camino Alto de Hortaleza 28.

The purpose of the file is to manage your relationship as a User of the Platform in all its aspects, as well as to send you our newsletter with information on the news regarding the Platform and the different activities carried out by Be Number One Sport. 13. FAQs

Information to know when registering for a competition:

• When you register for a Competition, the amount corresponding to the registration fee will be withdrawn from your wallet. You will know in advance the amount of that fee before registering. Keep in mind that if your wallet does not have the necessary amount to satisfy the registration fee, you will not be registered in the Competition and once you are registered it will no longer be possible to cancel your participation.

In the event that you are the creator of the competition, the registration will be made at the time it is created. In the section My BNOSport → My competitions the competitions in which you have registered are listed.

• Each Competition must have a minimum number of participants. If the minimum number of participants does not attend before the Competition starts, we will inform you that it has been canceled. We will also pay your registration fee to your wallet immediately.

• You can only register once in the same Competition and you must do it with your User.

• On the Competition page, the results will be reported to those Users who have participated in it.

• Whether you have won any of the awardsor not, we will contact you to inform you.

• Penalties: If a user performs an activity in which there are more meters of negative slope than positive, he will be penalized with the difference in seconds adding those seconds to the time of the competition. Example: A user has carried out an activity in which he has 200 meters of negative slope and only 40 of positive. Which will result in a 160 second penalty added to the competition time.

• Cancellations: You cannot cancel the registration made in a competition.

We allow the reproduction or transmission of the content of the Platform solely for informative or informative purposes and as long as the source is cited and its authorship is respected. Be Number One Sport, may show trade names, logos that are not their property, but always making use of the terms and conditions of those companies, such as citing their name, copyright and / or links to their websites and / or terms.

In the event that Be Number One Sport is a partner or has some type of association / collaboration with other companies, it will be notified.

In those sections in which you can contribute some type of content (such as in the customizable sections of your profile) you will be responsible at all times for the content provided by you, including the intellectual property rights corresponding to the images, videos and texts used, remaining Be Number One Sport in any case undamaged against any claim.

On the other hand, you authorize Be Number One Sport to exploit the rights of reproduction, commercialization and public communication (in all its forms) on the contents (works and services) that you provide through the Platform without temporal or territorial limitation, as well as that of transformation for the adaptations that are necessary, likewise guarantee the legitimate ownership or power of disposition of said rights.

14. Law and jurisdiction of the Platform

Our Platform is directed to Users located in Spain and the Conditions will be interpreted and governed by the laws of the Kingdom of Spain. This means that we agree to submit any discrepancies that may arise regarding your membership of the Platform to the jurisdiction of the Courts and Tribunals of the city of Madrid, as long as it is legally possible. In the event that any type of specific regulation establishes that the jurisdiction that must hear the matter that generates the controversy must be other than the one indicated, logically that specific rule will apply and the jurisdiction by default that we have said before will not have value.

Remember that by checking the option "I declare to have read this document that constitutes the Terms and Conditions of Membership to Be Number One Sport and I accept them" you agree to accept the following terms and conditions. You must be very clear that this document is the one that governs your status as a User of the Platform and it contains the conditions that apply to you as a User of the platform. Any new feature, tool or competition that can be added to the current service will also be subject to these Terms and Conditions of Membership, although these new conditions will only apply to Competitions that are not in progress.
